Lauren Johnson died after being run over by a speeding car.
She was hit in College Road, Crosby at about 1.20am and taken to hospital where she later died that same day on Friday 28 October 2016.
She had been on her way to the gym at the time.
The man had been speeding in a Toyota Auris car and had hit a van on College Road in Crosby and had then veered off along a pavement, travelling at 50mph in a 20mph speed zone and then hit Lauren Johnson.
The man that had been driving the car was not charged as the Crown Prosecution Service said that they thought that the man might have been insane at the time.
The Crown Prosecution Service said that the man had been in a daze and unresponsive due to illness at the time and that he might have been suffering from insane automatism. They said that medical evidence following an MRI scan showed that the man had hardening of the arteries in the brain and infarcts of the brain.
The decision not to charge the man was brought up for judicial review by Lauren Johnson's husband, who raised £30,000 through crowd funding to pay for the cost of the challenge, but whilst the judge admitted that 'On the face of it then, this was a clear piece of dangerous driving which caused the death of Mrs Johnson', he said that it was rational not to prosecute the man and his request for a prosecution was refused.
The Crown Prosecution Service added that the man would otherwise have been cleared of any offence by reason of insanity anyway.
However, Lauren Johnson's husband said that the Crown Prosecution Service had mistaken the medical evidence.
However, the judge noted that the Crown Prosecution Service had also taken into account other evidence, including dash-cam footage, eye-witness accounts and a forensic collision report, which he said concluded that there was strong support for the argument that the man had had no control over his driving in the moments before he collided with the van.
However, Lauren Johnson's husband disagreed with the judges conclusion.
Lauren Johnson was married and had two children. She was the manager at Shop Direct and had been on maternity leave at the time.
